Trms & Conditions – Our Agreement With You
Our agreement binds you and all members of your party, including any day visitors.� It is your responsibility to ensure that you are aware of, and accept, the whole of this agreement and the obligations contained in it.� It is effective from the date our agreement is formed and continues until the last member of your party has left the property (and includes any extensions of time to your booking).
All Bookings
Your contract is with Samui Escapes, a brand name of Jamberee Company Limited.� Samui Escapes act as agents for all property owners and other suppliers, we also supply holiday services to rental clients.� We have the right, at our sole discretion, to:
•refuse to accept any booking, and
•obtain the name, age and gender of each member of your party before confirming your booking or at any time.
•You must provide us with full details of the make up of your party prior to your arrival.� Failure to do so may result in access to the accommodation being delayed or even denied where the terms of this agreement may not have been met.
Confirmation
When you make your booking you must complete our booking form accepting on behalf of all your party the terms of these booking conditions and pay a 25% deposit as detailed on the booking form (payment method will be provided at the time of booking).� If the booking is made within 30 days of the arrival date, the total cost of the rental shall be due at the time of booking. A contract will exist only when we issue our confirmation invoice. You must complete the booking form detailing the number of properties booked, showing the names of persons in your party, home address and passport No.
Balance
The balance of the price of your booking must be paid at least 30 days prior to the arrival date.� Rentals for booking via our website are displayed in Thai Baht, Thailand regulations require that all charges are made in Thai Baht converted at the rate of exchange applied by the Bank of Thailand on the day of transaction.
If the balance is not paid in time we reserve the right to cancel your booking, retain your deposit and apply cancellation charges as set out below.
Price Guarantee
The price of your chosen property booked with us will not be subject to any surcharges after our confirmation invoice has been issued.
Alterations by you
If you wish to make any changes to your booking after it has been confirmed this must be communicated to us as soon as possible by e-mail.� We will try to assist wherever possible but cannot guarantee that any such changes can be actioned.� If we are able to comply with your requested change an administration fee of 1000 Baht will be charged together with any increased costs from our suppliers.� Where changes to your chosen property, are requested within 8 weeks of departure then cancellation charges as set out below may apply and the amended arrangements will be treated as a new booking. Cancellation charges will not apply for name changes where a party member is substituted for one who is prevented from travelling.
Alteration by us
We reserve the right to change any booking details on our website, including the price, before you book in which case we will tell you before the booking contract takes effect. Very occasionally a change or cancellation may occur after you have booked but before you depart. A change may be "major" or "minor". A "major" change is one which materially affects your confirmed booking, such as a change of accommodation to a lower standard than you have booked. Any other change is "minor". If there is a minor change before you depart we will try to let you know (although we are not obliged to do so) but you will not be entitled to cancel or receive compensation. If there is a major change before departure we will tell you as soon as practicable. We will then offer you the choice of accepting the change, taking the alternative accommodation (if it is more expensive you will have to pay the difference, but if it is cheaper you will receive the appropriate refund) or cancelling and receiving your deposit back.
Cancellation by you
You, or any member of your party, may cancel your holiday at any time providing the cancellation is made by the person who originally booked and is communicated to us by e-mail. As this incurs administrative costs, we will retain your deposit if you cancel more than 30 days prior to departure, and for less than 30 days we will require the full payment.
Cancellation by us
We reserve the right in any circumstances to cancel your booking.� However, in no case will we cancel your booking less than 8 weeks before the departure date except for reason of force majeure or failure on your part to pay the final balance.� Force majeure means war, threat of war, civil strife, industrial dispute, natural or nuclear disaster, bad weather, fire, level or water, terrorist activity, closure of ports or airports, unforeseen local building/roadworks or similar circumstances beyond our control.
In circumstances where we are unable to provide the property booked, we will return to you the deposit paid, or offer you an alternative property of comparable standard.
We have the right to cancel your booking, or to instruct you or your party to leave immediately, without compensation or refund should you or any of your party not comply with this agreement particularly where the rules and regulations relating to behaviour and conduct have not been complied with.
The maximum number of guests in each property unit must not be exceeded. If it is, we may accommodate those additional persons in another property unit, where available, and will charge you or them the appropriate full charge for that additional property for the whole of the relevant holiday period.
Insurance
Clients are responsible for arranging at the time of booking personal and medical travel insurance.
Security Deposit
You are expected to use your accommodation and its contents with care and are responsible for any and all damage caused to them; excluding normal wear and tear…a security deposit must be paid upon arrival and shall be returned in full after you vacate your chosen property provided these terms & conditions are complied with.
Arrival and Departure Times
During busy periods, guests should assume the Check-in time is after 1400hrs, and Check-out time is prior to 1200hrs.� However, Samui Escapes staff will ensure guests are accommodated during any overlap periods prior to Check-in and after
Check-out times.
Guests should inform us of flight arrival and departure times so that we can arrange for airport transfers to and from your chosen accommodation.
During Your Stay
Our aim is to provide holiday accommodation suitable for families in a relaxed environment. To ensure the maximum enjoyment of your holiday and that of all our other guests we require you to comply with all the conditions in this, ‘Our Agreement With You’, but draw your particular attention to the paragraphs below.
Accommodation
The accommodation is a privately owned dwelling with the owner’s furnishings, and neither Samui Escapes nor the owner shall be responsible for providing any additional furnishings or equipment not available presently in the unit.��� An inventory of your accommodation is available in advance upon request.� On departure you should leave your accommodation in a clean and tidy condition. We reserve the right to charge you for any extra cleaning or missing items.� We reserve the right to enter your accommodation at any time for any reasonable purpose, for example, to make checks, or carry out essential inspection, maintenance work, housekeeping or repairs.� You should observe that one or more of the locked cupboards are reserved for storage of the owner’s property and are not included in the accommodation rental.
Smoking policy
Smoking is not permitted inside any of the properties offered for rent by us.
Behaviour & Conduct
Your behaviour should not be excessive, noisy or disruptive, especially at night. Offensive or illegal behaviour will not be tolerated and may result in the police being involved.� We may ask you and/or any member of your party to leave immediately if your conduct is considered by us to be inappropriate, likely to cause harm, or impair the enjoyment, comfort or safety of your neighbours, our other guests, staff and the general public, or is likely, in our belief, to breach any of our agreement with you. No refunds or compensation will be given in these circumstances.� We have the right either during or after your stay to recover from you, the costs of:
•any compensation we may pay to others, including our other guests, and/or
•any property or accommodation damage, and/or
•any other charges, fees or levies we may incur resulting from your action or inaction and from any breach of our agreement with you.
Parking
Guests are requested to observe the parking rules detailed in the ‘Information Portfolio’, please contact Samui Escapes staff if you have any questions about the parking arrangements for your chosen property.
Pets
No pets are permitted in the accommodation
Safety
•Please drive carefully when using the road leading up to your chosen property.
•Dispose of cigarette stubs or matches with care using appropriate methods.
•Do not throw cigarette stubs or matches on the ground.
•Obey the rules regarding use of the swimming pool provided in the ‘Information Portfolio’.
•You are required to follow any additional safety advice given by our staff from time to time.
•Adhere to any safety notices displayed within the property or outside common areas.
Security of your property
We accept no liability whatsoever for any accident, loss or damage to your property unless such loss, damage or accident is demonstrably due to our negligence and:
•We will offer reasonable help to assist you in tracing lost items.
•Your personal belongings are your own responsibility during your stay� with us.
•Any vehicle parked in the designated parking area is subject to very limited security cover only.� You are therefore advised to lock your vehicle securely and remove all items on parking.
Guest Services
Samui Escapes may charge fees for products and/or services, as they deem appropriate.� We may also receive fees and commissions from others for the sale of goods or services.� Fees generated from such additional sales shall belong exclusively to Samui Escapes

Any concerns or assistance you require should be brought to our attention immediately. We will try to respond promptly to any concerns you raise so that you can continue to enjoy your holiday. Please help us by reporting any damaged or out of order facilities as soon as possible.
